Today we will discuss about the act which has been formulated to govern the general principles regarding the filing of suits and applications within pre-specified limits as stipulated under the said Act. The main purpose of this Act is to ascertain an outer limit within which an aggrieved person may file suits or applications in accordance with law. This is because otherwise the person who has done certain wrong will keep on anticipating endlessly that in future at some point of time an action will be initiated against him, which in turn will be prejudicial towards his rights to live in peace forever. Similarly this act thereby restricts a person to initiate any action after the expiry of the prescribed period or else it would be a never ending cause of causing mental agony to the person who has done wrong.
This Act has been divided into 31 Sections and 137 Articles. The articles has been classified in the Schedule which is again divided into various parts described as below:
PART 1----------Talks of Suits relating to accounts and it contains five articles i.e 1 to 5 prescribing a period of limitation of 3 years.
PART II---------Deals with the suits relating to contracts, containing articles 6 to 55, prescribing a period of limitation of 3 years,
PART III------Deals with the suits relating to declarations containing articles 56, 57 & 58, again prescribing a period of limitation of 3 years.
PART IV ------ Covers Suits relating to decrees and Instruments with Articles 59 and 60. The period of limitation is 3 years.
PART V---Suits relating to immovable property containing articles 61 to 67. The period of limitation is upto 12 years subject to specific conditions as dealt therein.
PART VI--- Suits relating to movable property. It contains Articles 68 to 71. The period of limitation is 3 years.
PART VII-- Suits relating to torts, It contains Article 72 to 91. The period of limitation is fixed bewteen one year to maximum of 3 years.
PART VIII-- Suits relating to trusts and trust property. It contains Articles 92 to 96. Period of limitation varies between 3 years upto 12 years depending upon each separate class.
PART IX--Suits relating to miscellaneous matters. It contains Articles 97 to 112. The period of limitation ranges from one year upto 30 years.
PART X-- It contains Article 113 which deals with the suits where no prescribed period of limitation has been fixed elsewhere in the schedule and it is fixed as 3 years from the date when right to sue accrues.
ARTICLES 114 to 117 deals with APPEALS and ARTICLES 118 to 136 deals with the applications.
LAST ARTICLE 137 contains those application wherein no period of limitation been provided elsewhere in the Schedule.
CONCLUSION
THE SCHEDULE CONTAINING THE ARTICLES TALKS ABOUT THE PRESCRIBED PERIOD OF LIMITATION CLASSIFIED UNDER DIFFERENT HEADS WHEREAS THE SECTIONS DEALS WITH THEIR APPLICATION AND COMPUTATION.
