JURISDICTION OF CONSUMER COURTS


INTRODUCTION 

Hello friends, today we shall discuss the procedure to determine how to know which consumer forum a consumer is expected to approach in case of a dispute within the meaning of the Consumer Protection Act.

Before moving ahead, it is important to differentiate between the territorial and pecuniary jurisdiction of the consumer court. 

Territorial Jurisdiction means a place where the consumer complaint is filed based upon the address of the parties. As per old Act, it was determined by the address of the OP i.e. Opposite party alone. However, as per recent changes in the Act, now a person can also file a complaint before a forum in accordance to its own address. Thus, for eg. a complainant before filing a complaint needs to ascertain under which police station his area is located and then on basis of that, the concerned consumer forum be selected.

 Pecuniary Jurisdiction 

On December 30, 2021, the Central Government notified Consumer Protection (Jurisdiction of the District Commission, the State Commission and the National Commission) Rules, 2021, as per which the below chnages / amendment in the jurisdiction was accepted:- 

As per recent changes, at present the following parameters is applicable:

Upto a sum of Rs. 50 Lacs -----District Forum

Between 50 lacs --- 2 Crores---State Commission 

Above 2 Crores --- National Commision 


(Please Note-- the above said amounts only denote the basic amounts and not inclusive of damages /compensation/interest being claimed additionally)

BENGALURU CONSUMER COURT IMPOSES PENALTY ON FLIPKART

RECENTLY BENGALURU DISTRICT CONSUMER FORUM DIRECTED ONLINE MERCHANT FLIPKART TO REFUND AN ANOUNT OF RS. 13,999/- ALONGWITH COMPENSATION OF RS. 10,000/- TO A 80-YEAR OLD FOR CAUSING MENTAL AGONY. BRIEF FACTS An 80 -Year Old Consumer ordered a treadmill on the online site of Opposite Party Flipkart. In compliance the treadmill was delivered to the consumer. At the time of installation of the product, it was revealed by the technician that the treadmill is faulty. RECENTLY KERALA HIGH COURT DISMISSED WRIT PETITION FILED UNDER ARTICLE  226 OF CONSTITUTION FILED BY FATHER ON BEHALF OF HIS 10- YEAR OLD GIRL FOR SEEKING AN ORDER TO ENTER SABARIMALA TEMPLE.
